2. Services Provided
PawsVIP offers pet boarding, daycare, grooming, transportation, and related pet care services. All Services are subject to availability, staffing, facility capacity, pet health and behavior requirements, and PawsVIP policies.
3. Booking and Payment
- Reservations must be made in advance via our website, customer portal, phone, or in person.
- Payments are due at the time of booking, check-in, checkout, or as otherwise stated for the specific Service.
- Accepted payment methods include major credit cards, debit cards, ACH or bank transfer when available, cash, and other electronic payment methods PawsVIP makes available.
- Prices, package terms, membership terms, deposits, surcharges, and fees are subject to change at any time unless otherwise required by law.
Cancellations and Refunds
- Cancellations must be made at least 24 hours before the scheduled Service to receive a refund or credit, unless a stricter policy applies to a holiday, package, membership, transportation, grooming, training, or special service.
- No-shows, late cancellations, holiday deposits, and special arrangements may result in partial or full charges.
4. Pet Health, Safety, and Owner Responsibilities
Vaccination and Health Requirements
- All pets must have current vaccinations and meet PawsVIP health requirements before receiving Services.
- You represent that your pet is healthy enough to participate in the Services requested and has not recently shown symptoms of contagious illness unless disclosed to and accepted by PawsVIP in writing.
Medical Emergencies
- If your pet becomes ill or injured while in our care, we will attempt to contact you using the contact information on file.
- If we cannot reach you, or if immediate care appears necessary, you authorize PawsVIP to seek veterinary or emergency care for your pet at your expense.
Behavioral Issues
- You must disclose any known history of aggression, biting, escape attempts, anxiety, illness, special needs, or other behavior or health issues that may affect your pet, other pets, staff, or property.
- PawsVIP may refuse, modify, isolate, or terminate Services if a pet poses a safety, health, operational, or behavioral risk.
Group Play and Incident Expectations
Dogs in daycare, boarding, and group play environments may occasionally experience minor scuffles, scratches, nicks, soreness, stress, upset stomach, tiredness, or transmissible conditions despite reasonable supervision, screening, cleaning, and care. PawsVIP will use reasonable efforts to monitor pets, separate pets when appropriate, and notify owners of material incidents, but minor incidents and normal group-play wear can occur as part of pet socialization and care.
5. Assumption of Risk, Release, and Liability Waiver
You understand and agree that pet care Services involve inherent risks, including risks that cannot be eliminated even with reasonable care. These risks include, without limitation, dog or cat bites, scratches, scuffles, rough play, fights, escape, stress, anxiety, property damage, illness, parasites, contagious disease transmission, allergic reactions, injury, aggravation of pre-existing conditions, and, in rare cases, severe injury or death.
- You voluntarily assume all inherent and ordinary risks associated with the Services, group dog play, boarding, daycare, grooming, transportation, handling, and interactions with other animals.
- To the fullest extent permitted by Washington law, you release and waive claims against PawsVIP, 1001 Partners LLC, and their owners, employees, contractors, agents, affiliates, and insurers for ordinary negligence related to the inherent risks of the Services.
- This release does not waive claims that Washington law does not allow to be waived, including claims arising from gross negligence, willful misconduct, or intentional wrongdoing.
- You remain responsible for injuries, losses, expenses, damages, veterinary bills, cleaning costs, property damage, or third-party claims caused by your pet or by inaccurate, incomplete, or omitted information you provide.
- PawsVIP is not responsible for lost, stolen, or damaged belongings left with pets, including toys, bedding, collars, leashes, clothing, carriers, or medication containers.
Limitation of Damages
To the fullest extent permitted by law, PawsVIP's total liability for any claim arising from or related to the Services is limited to the lesser of the fees paid for the specific Service or reservation giving rise to the claim or the fair market value of the pet under applicable law. PawsVIP will not be liable for indirect, incidental, consequential, special, punitive, emotional distress, loss of companionship, or sentimental-value damages except where such limitation is prohibited by law.
Indemnification
You agree to defend, indemnify, and hold harmless PawsVIP, 1001 Partners LLC, and their owners, employees, contractors, agents, affiliates, and insurers from claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your pet's behavior, your breach of these Terms, your failure to disclose material health or behavior information, or your violation of law. PawsVIP will indemnify you for third-party claims to the extent directly caused by PawsVIP's gross negligence, willful misconduct, or material breach of these Terms.
6. Pet Abandonment Policy
If a pet is not picked up by the scheduled departure date, additional daily boarding, care, veterinary, transportation, and administrative fees may apply until the pet is picked up, transferred, surrendered, or otherwise lawfully resolved.
If a pet appears abandoned and the owner cannot be reached after reasonable contact attempts, PawsVIP may exercise available rights and remedies under applicable Washington law, including boarding kennel lien procedures under RCW 60.56 where applicable. Nothing in these Terms authorizes PawsVIP to transfer, surrender, sell, or dispose of a pet in a manner inconsistent with applicable law.
7. Photo, Video, and Media Release
PawsVIP may photograph or record pets during Services for pet care updates, daily picture and video updates, facility operations, training, safety, marketing, social media, website, advertising, and other business purposes. You grant PawsVIP permission to use, reproduce, edit, publish, display, and distribute photos, videos, names, likenesses, and recordings of your pet without additional compensation, unless you opt out in writing before the photo or video is captured.
Please do not include children, family members, or other people in photos or videos submitted to or taken at PawsVIP unless you have authority to consent for them. PawsVIP will use reasonable efforts not to intentionally feature identifiable minors in public marketing without additional permission, but owners are responsible for keeping non-pet subjects out of customer-submitted media. You may request removal of future public marketing use by contacting PawsVIP; prior publications, shares, screenshots, cached copies, or third-party reposts may not be fully removable.
8. Messaging Consent & Opt-Out
By opting in through our website, customer portal, text, phone, in person, or other consent method, you agree to receive messages related to our Services, reservations, reminders, pet care updates, account notices, and promotional offers where permitted by law. You can opt out at any time by:
- Replying "STOP" to any SMS message.
- Contacting us at (425) 230-0344.
- Updating your preferences in your online account, if available.
9. Dispute Resolution, Arbitration, and Class Action Waiver
Please read this section carefully. It affects your legal rights. You and PawsVIP agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, your pet, your account, communications, billing, advertising, or your relationship with PawsVIP will be resolved by binding individual arbitration, rather than in court, except for claims that may be brought in small claims court or claims that cannot be required to be arbitrated under applicable law.
- The Federal Arbitration Act governs this arbitration agreement to the fullest extent permitted by law.
- Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules unless the parties agree to a different arbitration provider.
- Arbitration will take place in King County, Washington, remotely, or by documents only, as allowed by the arbitrator and applicable rules.
- You and PawsVIP waive the right to a jury trial and agree to bring claims only on an individual basis.
- No class action, collective action, consolidated action, private attorney general action, or representative proceeding may be brought or maintained in arbitration or court, except where this waiver is prohibited by law.
- If the class action waiver is found unenforceable as to a particular claim, that claim must proceed in court and not in arbitration, but all other arbitrable claims will remain subject to arbitration.
Notice and Opportunity to Cure
Before filing any arbitration or lawsuit, the party asserting a claim must provide written notice describing the claim, requested relief, and supporting facts. The receiving party will have 30 days to investigate and attempt to resolve the dispute informally. Notices to PawsVIP must be sent to the contact information in Section 14. Notices to you may be sent to the email, phone, mailing address, or account contact information you provided.
Time Limit to Bring Claims
To the fullest extent permitted by law, any claim arising from or related to the Services or these Terms must be filed within one year after the claim arose, or it is permanently barred.
10. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles, except that the Federal Arbitration Act governs the arbitration agreement above where applicable. For claims not subject to arbitration, venue and jurisdiction will be in the state or federal courts located in King County, Washington, unless applicable law requires otherwise.
11. Integration; No Reliance on Marketing Statements
These Terms, together with any written reservation, invoice, membership, package, grooming, transportation, veterinary authorization, or facility-specific policy accepted by you, are the entire agreement between you and PawsVIP regarding the Services. You agree that you are not relying on statements, advertisements, website copy, social media posts, oral statements, or other marketing materials as contractual promises unless they are expressly included in a written agreement signed or electronically accepted by both parties.
12. Severability and Waiver
If any part of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. PawsVIP's failure to enforce any provision is not a waiver of its right to enforce that provision later.
13. Changes to These Terms
PawsVIP reserves the right to modify these Terms at any time. Updates will be posted on our website with an updated effective date. Continued use of the Services after updates are posted constitutes acceptance of the revised Terms, to the extent permitted by law. Material changes may require additional notice or acceptance where required by law or PawsVIP policy.
